UPDATE: JUDGE APPROVES $1.8M SETTLEMENT IN DEADLY CRASH INVOLVING FIRE ENGINE – MISSOURI

KANSAS CITY, Mo. — A judge has approved Kansas City’s $1.8 million settlement in a deadly Westport crash involving a firetruck.

The December 2021 crash near Broadway Avenue and Westport Road killed 41-year-old Jennifer San Nicolas, and 25-year-old Michael J. Elwood. Both were in an SUV when it collided with the firetruck. A pedestrian, 41-year-old Tami N. Knight, was also killed in the crash.

The families of the three victims filed a wrongful death lawsuit against the city, fire department and Dominic Biscari, the firefighter driving the truck. A property owner whose building was damaged also sued the city.

In November, the Kansas City Council authorized the city attorney to use $1.8 million to resolve four lawsuits.

State law caps the city’s liability for all the lawsuits at $1.8 million.

There are still other lawsuits still pending against Biscari and against the city in this crash. Prosecutors have not filed any charges against Biscari.

The Kansas City firetruck was responding to a possible weather-related fire when the department said it was called off and another firetruck was dispatched.
But with lights and sirens on, the firetruck continued north on Broadway Avenue and through the intersection on a red light. The crash happened about a minute later.

The force of the crash sent the vehicles into a Westport building that collapsed.

As FOX4 previously reported, a September 2021 email shows Biscari had been recklessly driving an ambulance months before the deadly crash. The email documents three instances the author directly witnessed:

  • Driving 70 mph on Broadway when it wasn’t necessary,
  • Driving fast, taking hard turns with critical patient, knocking EMT’s off a bench seat, and
  • Sending the ambulance airborne on 27th Street west of Gillham Road, down a steep incline.
The employee told a superior in the email:

“I went home in physical and mental pain because of my shift yesterday. I will not be getting into another ambulance with [Biscari] ever again. Please something needs to be done. Not only for the safety of other personnel and other citizens but he is tearing up a brand new ambulance.”
